Use of this site is governed by these terms of use and legal restrictions. Using this site indicates your acceptance of these terms. Do not use this site if you do not accept these terms. ClubPontoon, its name, logo and graphics are a trademark of CES. All other trademarks displayed on this site are the trademark of their respective owners, and no association or endorsement with CES is implied.

User Submissions
Any material, information or other communication transmitted to this site will be considered non-confidential and non-proprietary. CES has no obligations with respect to these transmissions. CES will be free to copy, disclose, distribute, incorporate and otherwise use all communications including data, images, sounds, texts or other attachments or embodiments, for any and all commercial or non-commercial purpose. Users are prohibited from transmitting to or from this site any unlawful, threatening, libellous, racial, defamatory, obscene, pornographic or other material that would violate any law.

Limitation of Liability
CES WILL ENDEAVOUR TO KEEP THE DATA ON THIS SITE ACCURATE, BUT ITS EMPLOYEES AND AGENTS WILL NOT IN ANY EVENT BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING LOST PROFITS, DATA OR BUSINESS INTERRUPTION) RELATED TO ANY USE, REPRODUCTION, MODIFICATION OR DISTRIBUTION OF THE INFORMATION, DATA, DOCUMENTATION OR LINKS LISTED OR PROVIDED BY THIS SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT OR ANY OTHER LEGAL THEORY.

Applicable law may not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to you.

Interruptions
The customer understands and agrees that temporary interruptions of services provided by CES may occur from time to time. CES agrees to exercise reasonable care to prevent such occurrences. Under no circumstances will CES be liable for any financial or other damages due to such interruptions.

Third party sites
Links to third party web sites on this site are provided as a convenience to you. If you use these links, you will leave this site. CES has not reviewed all of these third party sites and does not control and is not responsible for any of these sites, their content or availability. Thus, CES does not endorse or make any representations about them, or any information, software or other products or materials found there, or any results that may be obtained from using them. Use of third party sites is done entirely at your own risk.

Member Account
You are responsible for the security of any user identification codes, agreement codes, login codes and passwords. You are also responsible for governing the use, sharing and re-assignment of same. CES is not responsible for any unauthorized use of these details or your inability to access your account, and you must inform CES immediately of any unauthorized use, or breach of security.

You must ensure you log off your account at the end of each session.

You must ensure all information submitted is kept accurate and current throughout the period of your membership.

You may not use the account for any unlawful activity.

Any breach, or suspicion of breach in any terms may result in your account being suspended or cancelled.

CES reserve the right to cancel any member account at any time. The member will be notified via their registered email address.

Privacy
To register an account with CES, we ask for your name and email address. Once you register, this information is known to us. CES will not sell or rent part or all of this information to anyone, unless a) required by a legal process or legitimate authority or b) CES are acquired by or merged with another company, in which case you will be notified of any new terms.

We may use the information for specific email marketing by ourselves or any third party, unless you have opted out of receiving such emails. We will not give the third party your name, email or any personal information. You can opt out of said emails at any time by selecting the option in your account administration page.

CES may also collect and analyse other personal and habitual information about your visit. This may include your computers IP Address, web browser and operating system, and your behaviour on the web site, such as items viewed or third party links accessed or arrived from.

Cookies
